Charles L. Smith was sued in an action of debt, before a justice of the peace, to recover the penalties prescribed by the act to regulate the practice of medicine in the State of Illinois, in force J uly 1, 1899, for practicing medicine without a license from the State Board of Health. The cause was removed to the Circuit Court by appeal, and was there tried without a jury and defendant was convicted, and judgment was entered against him for $100 and costs, and it was further ordered that in default of immediate payment of the fine and costs, defendant be committed to jail for thirty days, or…
