*1038Appeal from an order of the Supreme Court, Erie County (John F. O’Donnell, J), entered May 21, 2003. The order granted the petition to vacate the arbitration award and denied the cross petition to confirm the arbitration award.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously reversed on the law without costs, the petition is denied, the cross petition is granted and the arbitration award is confirmed.
