TYLER, District Judge.

The purpose of this memorandum and order is to dispose of a number of procedural and other problems which confront counsel and the court as a result of certain post-verdict developments in this case.

To put these matters in reasonable focus, it may be helpful to recite some of the history of the proceedings, particularly those after the jury rendered a verdict late in the evening of February 16, 1964 after some five and one-half months of trial.
