Appeal by the defendant from a judgment of the Municipal Court of the city of New York, borough of Manhattan, sixth district, rendered in favor of the plaintiff.

The plaintiff purchased from the defendant certain furniture and agreed to pay for it in instalments. At the time of the purchase the plaintiff executed a chattel mortgage upon the furniture as security for the payment of the purchase price. The plaintiff paid instalments of $190, and then defaulted in the payment of the further instalments, and the *427defendant thereupon took possession of the goods under the chattel mortgage.
