Appellant, claiming to be the Widow.of Jacob Schwingle, deceased, and to own a community interest in Ms estate, ap-. plied to the county court for a partition, of the estate, the administration of which was pending in that court. She alleged that Jacob Schwingle died on December 11, 1908, leaving a will, which was duly probated, by which he bequeathed a portion of his estate to his executor, Charles C. Keifer, to be used in maintaining a home for. the aged and indigent in El Paso, $50 to a church, and the remainder to various other parties, who are appellees herein, and that one-hall'…
