Larus Casto brought a civil action in the United States District Court for the Southern District of West Virginia against The New York Central Railroad Company (hereinafter called Central), to recover damages sustained in a collision between the automobile that Casto was driving and an engine of Central. Central moved for a directed verdict at the close of all the evidence; this motion was overruled, and the jury returned a verdict in favor of Casto for $7,000.
