In November 2008 the citizens of Kinston, North Carolina approved a referendum making local elections nonpartisan. Because Kinston is located in Lenoir County, one of several North Carolina counties covered by § 5 of the Voting Rights Act (“VRA”), see 30 Fed. Reg. 9897 (Aug. 7, 1965), the city had to seek preclearance from the Department of Justice before the law could take effect. See 42 U.S.C. § 1973c.
