— Judgment unanimously reversed, on the law, and defendant remanded to Supreme Court, Monroe County, for further proceedings, in accordance with the following memorandum: Defendant was charged with murder in the second degree for the strangulation killing of his girlfriend, Charlotte Arline, on May 15, 1979.
