The infant appellant, Joseph Benge, instituted this action by his next friend and guardian, against Samuel Hiatt’s administrator, in the Garrard circuit court, asking a judgment for the sum of $6,700 against the estate of the intestate, by reason of a contract alleged to have been made by the mother of the infant with the intestate for the infant’s benefit. The case went. *668off on demurrer, and the only question presented is •as to the sufficiency of the petition.
