This action was commenced before a justice of the peace by attachment. The defendants appeared, pleaded to the merits in writing, and submitted to a jury trial, which resulted in a verdict and judgment in favor of the plaintiff. Prom this the defendants appealed to the circuit court, and in that court moved to dismiss the proceeding on various grounds, among which was the ground that no petition, account, statement, instrument or exhibit constituting any cause of action had been filed with the justice, as required by the statute.
