RITTER, District Judge.
This matter comes on for hearing on a petition for review of the findings and order of the referee requiring Ida Silver to turn over property in her possession whieh the referee finds is the property of the bankrupt.
Ida Silver was not a pai-ty to the proceedings in the bankruptcy hearing, by in*629tervention or by consent. The property which she has in her possession was not in the possession of the trustee in bankruptcy at any time.
