This matter comes before the Court on a motion by the plaintiff, Seaboard Surety Company (“Seaboard”), seeking partial summary judgment only as to liability against the defendants Interstate Construction Company, Inc. (“Interstate”), Gulfshore Development Corporation (“Gulfshore”), Congress Construction, Inc. (“Congress”) and William A. Nicholson (“Nicholson”) (collectively the “Indemnitors”) on Counts I, II, III, IV, V and VI2 of the amended supplemental complaint.
