Plaintiff has moved under Rule 56, Fed.Rules Civ.Proc. 28 U.S.C.A., for the entry of summary judgment in its favor dismissing the counterclaim filed by the defendants, William W. Miner et al. and the counterclaim filed by the defendants, Burgess Lunsford et al. These counterclaims assert substantially similar grounds for relief although the verbiage in the latter with respect to threatened injury to rights and property is the more specific and detailed.
