On December 31, 2003, Mr. William E. Trotter, II (Trotter) issued a check made payable to Charles M. Fife, Jr. & Associates, L.L.C. (Fife, LLC) in the amount of $350,000.00. Mr. Charles M. Fife, Jr. (Fife) negotiated the check for Fife, LLC, which is wholly owned by Fife. Trotter believed and understood that he was purchasing five royalty acres in a tract of land known as the “Ramos Field,” a highly productive gas field with a strong production record preceding that date.
