This is an action for damages for personal injuries suffered by plaintiff Richard A. Preissman, a minor, when an automobile, which had been parked in a parking lot by defendant Michael Shay, rolled (unattended) down an incline and struck Richard, who was an attendant at the parking lot. One of the questions herein was whether there was a defect in the automobile mechanism for locking the transmission gears when the automobile was in a parked position.
