In my opinion the disposition of this case is contrary to SDC 14.0301; 14.0302; In re Scott’s Estate, 61 S.D. 253, 248 N.W. 247 and Smith v. Smith, 71 S.D. 305, 24 N.W.2d 8, and I therefore respectfully dissent.
