PERRY, Judge.

Carl T. Morris appeals from the district court’s order denying his I.C.R. 35 motion for correction of an illegal sentence. For the reasons set forth below, we reverse and modify Morris’s sentence.

The background of this case is not in dispute. Morris committed certain crimes in November 1990 for which he was charged with first degree burglary, I.C. §§ 18-1401, - 1402, and malicious injury to property, I.C. § 18-7001.
