Action to collect superadded liability from a stockholder in an insolvent bank. The amended answer and counterclaim occupy about 16 printed pages, but, in substance, may be stated briefly as follows: That on November 21, 1924, and for several years prior thereto, Lumbard State Bank had a capital stock of $25,000, most of which was owned- and all of which was controlled by the Lumbard family; that on that date the bank was insolvent and was taken in charge by the superintendent of banks; that instead of proceeding with the liquidation of the bank, the superintendent and officers of the bank…
