The defendant was indicted on several counts of possessing a large capacity firearm1 (indictment number BRCR 2005-00946-1), in violation of G. L. c. 269, § 10(m), and one count of possessing ammunition without a firearm identification (FID) card (indictment number BRCR 2005-00946-2), in violation of G. L. c. 269, § 10(A). Prior to pleading guilty, the defendant moved for relief pursuant to Mass.R.Crim.P. 13(c), as appearing in 442 Mass. 1517 (2004), arguing that the sentencing provisions of G.
