This is an appeal from the order denying Appellant’s first petition for relief under the Post Conviction Relief Act (PCRA), 42 Pa. C.S.A sections 9541-46. We vacate the order denying post-conviction relief, and remand for a determination of Appellant’s indi-gency and the appointment of counsel.
