MEMORANDUM OF DECISION AND ORDER

I. BACKGROUND
This action arises out of a weapon discharge occurring on the morning of May 15, 2004, and the subsequent detention and search of the plaintiff, Charlie Green, by members of the Riverhead Town Police Department in connection with their investigation of this incident.
