This case was originally assigned to another judge on the Alabama Court of Criminal Appeals. It was reassigned to Judge Cobb on January 17,1995.

The appellant in this case, T.R.D., a juvenile, was charged in a delinquency petition with the murder of Vicki Lynn Deblieux, made capital because it was committed during the course of a kidnapping in the first degree. § 13A-5-40(a)(l), Ala.Code, 1975.
