Action for damages. Appeal from the Circuit Court of Vermilion county; the Hon. E. R. E. Kimbrough, Judge, presiding. Heard in this court at the May term, 1906.

delivered the opinion of the court.

B. F. Boaz brought suit in the Circuit Court'of Vermilion county against the Toledo, St. Louis & Western Bailroad Company, to recover damages, which, it is alleged, he sustained by reason of the failure of the railroad company to transport with care and within a reasonable time, a carload of horses, from Bidge Farm, Illinois, to Norwich, Connecticut. Upon trial in the court a jury returned a verdict in favor of Boaz in the sum of $600.. Judgment was rendered on the verdict and the railroad company appealed.
