This is an action upon a promissory note. The defense is want of consideration, lack of privity of contract and fraud. Upon trial to a jury, verdict was returned in defendant’s favor. Later, the trial court ordered and rendered judgment in plaintiff’s favor notwithstanding the verdict. Defendant has appealed from the judgment and order. The facts are: Plaintiff is a. farmer residing near Carrington, North Dakota.
