The regularity of the proceedings in this matter is not questioned, nór is the city interested. The point involved is the validity of the award made to Philip Dietrich for the value of a leasehold interest in certain premises affected by the widening of One Hundred and *29Tenth street. Henry A. Cram was the owner of the premises involved during his lifetime. He died, leaving a last will and testament, which was duly admitted to probate in the county of Yew York on the 1st day of May, 1894.
