In these consolidated appeals, appellant Theodore Junior appeals from his conviction of distribution of cocaine, D.C.Code § 33-541(a)(1) (Repl.1989), and the denial of his motion to vacate his conviction and sentence, pursuant to D.C.Code § 23-110. In both appeals he contends that he was denied the effective assistance of trial counsel, and that the trial judge erred in denying his motion without a hearing because, he maintains, trial counsel was ineffective in failing to file a motion to suppress identification testimony and physical evidence obtained in a warrant-less…
