The Southern Home Building and Loan Association sued the Home Insurance Company upon a policy of insurance issued by the defendant, insuring Rosa Tutty upon certain property for one year from December 17,. 1892, to an amount not exceeding $1,000, “ loss if any payable to the Southern Home Building and Loan Association as their interest may appear.” Attached to the policy was what is called the “New York Standard Mortgagee Clause,” in which it was stated that loss under the policy should be payable to the Southern Home-Building and Loan Association as mortgagee, as its…
