The defendant owned a building in the city of Milwaukee which was occupied by plaintiff as his tenant, and used as a boardinghouse. He commenced-proceedings for unlawful detainer, and secured a writ of restitution. This writ was put in the hands of an officer, and was executed by the removal of plaintiff’s household goods from the house.

The respondent directs our attention to the fact that the judge’s charge is not contained in the bill of exceptions. This is important, as many of the assignments of error #are based upon alleged mistakes of law contained therein.
