Appeal from the District Court of the First Judicial District, Storey County. The property, the subject of this action, is situate in the town of Cold Hill, Storey County, about a half mile northerly from the Devil’s Gate Toll House. The verdict and judgment were in favor of plaintiff, for possession of the property and one dollar damages. The action was commenced in January, 1867, and the appeal taken in December, of that year.

This is ejectment for a tract of land situated in the County of Storey; with a complaint in the usual form. The defendant answered, denying all the allegations of the plaintiff’s pleading, except the possession by himself, and also alleged facts relied on by him as an estoppel against the plaintiff’s right to recover.
