Tbe place where this crime is alleged to have been committed is somewhat remote from any city or town. There is a highway-running north and south,- and on the land adjoining this highway on the east is where it is said to have occurred.
The first seven errors assigned go to the question of the sufficiency of the testimony to support the verdict. The land where the crime was alleged to have been committed was owned by one Perigo. One Perkins, an employee of Perigo’s, was engaged in mowing weeds on the land in August, 1928. It appears that at one time, at a point on the land some 60 feet' east…
