OPINION
KLINGEMAN, Justice.
This is an appeal by the City of San Antonio’s Firemen’s and Policemen’s Civil Service Commission (City) from a summary judgment reinstating Michael Villanueva (Villanueva) to his former classified position of patrolman in the City Police Department, reimbursing him for all of his lost back pay, and awarding him attorney’s fees.1 Prior to February 29,1980, Villanue-va was a duly appointed and enrolled patrolman in the City Police Department.
