I. Procedural History

On 7 May 2009, Plaintiffs Andrew C. White and Barbara W. White filed a complaint in New Hanover County Superior Court seeking damages related to alleged construction defects in Plaintiffs’ home. Plaintiffs brought various claims against the builder of the home, Collins Building, Inc. (“Collins Building”), Collins Building’s president, Edwin E.
