KRUEGER, Judge. —

Appellant was convicted of the offense of burglary, and his punishment was assessed at confinement in the state penitentiary for a term of three years.

The record shows that on the night of January 25, 1936, some person or persons entered the store of P. H. Michael and took therefrom some flour and sugar, carried it to near Wright’s Warehouse, and covered it with men’s coats. Soon after the burglary was committed,- the officers were notified, and in their search discovered three persons running from the place where the flour and sugar was found covered up.
