Appeal from a judgment of the Supreme Court at Special Term (Hughes, J.), entered September 24, 1982 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to, inter alia, annul a determination of the State Department of Health reducing petitioner’s Medicaid reimbursement rate by 2% for failure to timely file cost reports for 1978 and 1979.
