CHAPMAN, J.:

The evidence of the parties, in the case at bar, adduced in support of defendant’s second and third amended pleas to plaintiff’s amended declaration, was submitted to a jury, in the Circuit Court of Broward County, Florida, under instructions by the trial court, resulting in a verdict and judgment for the plaintiff below. An appeal therefrom has been perfected to this Court. The amended declaration appears in our former opinion. See Gore v. General Properties Corporation, 149 Fla. 690, 6 So. (2nd) 837.
