In an action to recover damages for personal injuries, the defendant appeals from an order of the Supreme Court, Kings County (Vinik, J.), dated February 2, 1996, which granted the plaintiffs motion for partial summary judgment on the issue of liability.
Ordered that the order is reversed, with costs, and the motion for partial summary judgment is denied without prejudice to renew after the completion of discovery; and it is further,
