— In a proceeding pursuant to CPLR article 78 to review a determination by the Planning Board of the Town of Pawling not to approve petitioner’s subdivision plat, the board appeals from an order of the Supreme Court, Dutchess County (Jiudice, J.), dated July 7, 1982, which, upon reargument, vacated its prior judgment, granted the petition, annulled the determination of the board and directed it to approve the proposed plat.
