This is an original proceeding in habeas corpus. The petitioner alleges that he is illegally restrained by the warden of the state penitentiary at Mc-Alester; that he is confined under a conviction from the district court of Pawnee county on a charge of robbery. He then assigns two1 reasons why he contends the judgment is void. The state demurred to that part of the petition in which it is claimed the judgment is void, and the demurrer was sustained for the reason that these allegations contain nothing that can be raised by habeas corpus.
