Appeal from an order of the Special Term entered in the Broome County Clerk’s office on *1011September 21, 1944, restraining the defendant from proceeding with an action for divorce against the plaintiff in the State of Nevada and from prosecuting any other action against plaintiff affecting the marital status of the parties dn any court in any jurisdiction other than the State of New York. This is a matrimonial action for a separation on the ground of cruel and inhuman treatment. The answer denies such conduct and sets up a counterclaim for a separation on the same ground.
