At 5 o’clock p. m. on December 25, 1911, the infant plaintiff fell off the porch of H. F. Cochran, a distance of approximated three feet, and his right arm was injured by the fall.…

'1. The defendant filed a demurrer to so much of the 10th paragraph of the petition as refers to a photograph “of the present condition” of the plaintiff’s hand and arm, and moved the court that the same be stricken and the photograph removed from the petition and taken out of the record and excluded from the consideration of the jury. The court overruled the demurrer, and allowed the photograph to remain attached to the petition. To this judgment the defendant excepted pendente lite.
