Appellant was convicted1 upon an information charging that, by the use of certain instruments in and upon, the body of one Alice Leuth, who was then pregnant with a quick child with intent then and there on the part of appellant to derstroy the said child, appellant caused the death of the said Alice Leuth, and that the destruction of the said child was not necessary for the preservation of the life of the said Alice Leuth'
