Appeal from a judgment of the County Court of Schenectady County (Eidens, J.), rendered July 17, 2003, upon a verdict convicting defendant of the crimes of criminal mischief in the fourth degree, criminal contempt in the first degree and assault in the third degree.

Defendant was the long-time boyfriend of the victim and the father of her four children. In April 2002, police responded to a report of domestic violence at the place where defendant and the victim resided and observed injuries to the victim’s arm and leg as well as a damaged bathroom door that defendant had allegedly kicked.…
