Defendant in error entered into a written contract, on the 25th day of February, 1865, with John E. Squire and O. D. Payne, by which he, in consideration of one dollar and the agreements contained in the contract, bargained, sold and conveyed to them, their heirs and assigns, all of the coal, limestone, iron ore, rock oil, and ■ other minerals in, upon or under a certain farm or tract of land, which was particularly described, and containing 700 acres.
