Belknap, C. J.:

Action for malicious prosecution.

The case was tried by the court without a jury.

Respondent recovered judgment for $305 and costs.

After respondent had introduced his testimony in chief, appellartt moved for a non-suit upon the ground that there was no evidence tending to show that the prosecution was maliciously instituted, or without probable cause, or that respondent had heen damaged in his person.

The motion was denied and the ruling is assigned as error.
