The petitioner seeks his release from the State Prison at Folsom by this proceeding in habeas corpus. The writ was issued. The petition and the return show the following:

On June 9, 1938, in Los Angeles County, the petitioner pleaded guilty to a charge of violation of section 476a of the Penal Code (issuance of checks without sufficient funds with intent to defraud) and admitted a prior conviction of' a felony (forgery).
