Ordered that the unpublished decision and order of this Court dated February 20, 1996, in the above-entitled case, is recalled and vacated, and the following decision and order is substituted therefor:

In an action to recover no-fault medical payments under an *614insurance contract, the plaintiff appeals from an order of the Supreme Court, Nassau County (Franco, J.), dated May 3,1995, which denied its motion for summary judgment.
