In this case, the defendant below, before the justice of the peace, to whom the complaint was originally preferred, for an offence within his jurisdiction, interposed a demurrer to the complaint, which was overruled by the justice ; who thereupon rendered judgment against the defendant for the penalty prescribed by law.
