Appeal from judgment on report of referee. James A. Fatteson brought suit against Amelia M. Graham, formerly A. M. Whittock, to recover for money loaned. Trial before a referee, and judgment for plaintiff on his report, from which the defendant appealed.

This is an appeal from a judgment entered upon the report of a referee in favor of the plaintiff against the defendant for the sum of $5,321.09. The action was brought to recover the sum of $2,000, alleged to have been loaned and advanced by the plaintiff to the defendant, at her in*3stance and request, on or about the 24th day of February, 1863, and which it is alleged she undertook and promised to repay, with interest at 7 per cent. The defendant by her answer denied the loan, and pleaded as a separate defense that, at the time it was alleged to have been made, she was a married woman.…
