STAKELY, Justice.

This is an original petition to this court for mandamus to compel D. C. Halstead, Judge of the Twentieth Judicial Circuit, to vacate an order, awarding the custody of a child pendente lite. The theory of the petition is that the court had no jurisdiction to make the order. Upon issuance of the rule nisi, Judge Halstead filed answer ■and the cause is submitted here on petition and answer.
