OPINION

BRUGGINK, Judge.

Pending before the court is Defendant’s Motion for Partial Summary Judgment, asserting that Count I of plaintiff’s two-count complaint must be dismissed for lack of subject matter jurisdiction. The general issue to be resolved in this case is a novel one: does a surety have the right to assert, independently of the contractor, claims against the government for amounts other than the “contract price?” Upon consideration of the written and oral arguments of the parties, the court concludes that under the circumstances presented here, it does *795not, and dismisses all but one…
